The short version

Fizzlayer is an early service, offered as is.
Hobbyist is free. Paid plans renew monthly until you cancel, and you can cancel any time.
Your sensor data stays yours.
Fizzlayer is not a safety alarm. Never rely on it alone to protect people or property.
Only record people, track locations, and call phone numbers when you have permission.

Fizzlayer is not a safety system

Do not use Fizzlayer as your only protection against fire, gas leaks, floods, carbon monoxide, medical emergencies, break-ins, or any other danger to people or property. Readings can be wrong or late. Alerts and phone calls can be delayed or fail, and AI answers can be mistaken.

Use certified alarms and detectors for safety. In an emergency, call your local emergency number.

01Agreeing to these terms

Fizzlayer (fizzlayer.com) is run by Nisarga P, an individual developer, referred to here as “we” or “us”. These terms cover the Fizzlayer website, app, API, MCP server, and the fizz command-line tool. Fizz is the name of the AI agent and mascot inside Fizzlayer.

By creating an account or using Fizzlayer, you agree to these terms and to our Privacy Policy. If you use Fizzlayer for a company, you agree on its behalf and confirm you are allowed to do so.

You must be at least 13 years old. If you are under 18, or under the age of adulthood where you live, a parent or guardian must agree to these terms for you.

02Your account

Keep your password, passkeys, sensor keys, and agent tokens private. You are responsible for what happens with them.
Tell us right away at privacy@fizzlayer.com if you think someone else is using your account.

03Your data

You own the sensor readings, names, alerts, recordings, and other content you put into Fizzlayer.

You give us permission to store, process, and send that content only as needed to run Fizzlayer for you. That includes sending it to the service providers listed in our Privacy Policy. This permission ends when you delete the content or your account.

04Acceptable use

Do not use Fizzlayer to:

Break the law, or help anyone else break it.
Spy on, harass, or harm anyone.
Send content you have no right to share.
Break into, overload, or disrupt Fizzlayer, or get around its rate limits or security.
Access other people’s accounts or data.
Resell Fizzlayer or build a copy of it from our service without our written permission.

Fizzlayer can capture audio, location, and motion, and can phone people. You are responsible for using these lawfully:

Audio and transcripts: only record where you are allowed to. Many places, including California, require everyone being recorded to agree.
Location: only pair a phone you own or have permission to track.
Alert calls: only pair a phone number that is yours, or whose owner agreed to get automated calls from Fizzlayer. Pairing works by Fizzlayer calling that number and reading a code you enter. A number that is not paired is not called.

06AI features

Fizzlayer uses AI to answer questions and set up alerts. AI answers can be incomplete or wrong, even when they sound sure. Check anything important yourself. Do not rely on AI answers for safety, medical, legal, or financial decisions.

07Agents, devices, and other services

When you give an AI agent a Fizzlayer token, that agent acts for you. You are responsible for what it does with Fizzlayer.
You are responsible for the devices and sensors you connect, and for keeping them safe.
Fizzlayer relies on other services, such as hosting, AI, voice, and phone providers. We are not responsible for their outages or actions.

08Plans, payments, and changes

Plans

The Hobbyist plan is free. Tinkerer and Pro are paid monthly subscriptions at the prices shown on our pricing page when you subscribe. Enterprise terms are agreed with you separately.
Each plan includes a number of connected devices and a monthly allowance of Fizz credits. One credit is one message to Fizz. Credits reset on the first day of each month (UTC), do not roll over, and have no cash value.
Phone calls, including the call that pairs a number, are included with Tinkerer, Pro, and Enterprise. The Hobbyist plan can create dashboard alerts and does not place calls. If your account returns to Hobbyist, calls that are still waiting are not dialed.

Payments

Payments are handled by Stripe. We never see or store your full card number.
When you subscribe, you authorize us to charge your payment method each month until you cancel.
You can change plans or cancel any time from Manage billing in Settings. A cancellation takes effect at the end of the billing period you have already paid for. You keep your paid plan until then, and your account then returns to Hobbyist.
If a payment fails, we may keep your plan active while Stripe retries. If it still fails, your account returns to Hobbyist.
Payments are not refundable, except where the law requires a refund.

Changes

We may add, change, limit, or remove features, plan limits, or prices, or stop offering Fizzlayer entirely. We will tell you by email at least 30 days before a price increase applies to your subscription, so you can cancel first. A change to your plan never takes away what you have already paid for in your current billing period. If we plan to shut down, we will try to give you notice so you can save your data.

09Ending your use

You can stop using Fizzlayer at any time. To delete your account and data, email privacy@fizzlayer.com.

We may suspend or close your account if you break these terms, put others at risk, or create legal trouble for us. Where it is reasonable, we will tell you why first.

Sections 10, 11, and 12 still apply after your use ends.

10Disclaimers

Fizzlayer is provided “as is” and “as available”, without warranties of any kind. As far as the law allows, we disclaim all warranties, including that Fizzlayer will be accurate, reliable, uninterrupted, secure, or fit for a particular purpose.

11Limits on liability

As far as the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost data, profits, or property. This includes losses caused by missed, late, or wrong readings, alerts, or calls.

Our total liability for any claim about Fizzlayer is limited to the greater of what you paid us in the 12 months before the claim, or US $100.

Some places do not allow these limits, so they may not all apply to you.

12Governing law

California law governs these terms, except its rules about conflicts between laws. Disputes will be handled in the state or federal courts in California, and both sides agree to those courts.

13Updates to these terms

We will update the date at the top when these terms change. For important changes, we will also tell you by email or in the app before they take effect. If you keep using Fizzlayer after that, you accept the new terms.
